How to Register a Property Mortgage in Dubai

A property mortgage in Dubai must be formally registered with the Dubai Land Department. Signing a loan agreement with a bank is not enough on its own. Registration places the mortgage on the property record and protects the financing entity’s registered rights.

The mortgage may be registered on a completed property, a usufruct right, or an eligible property recorded in the provisional register. Dubai Land Department also allows first-degree and second-degree mortgages, depending on the property record and approved financing arrangement.

What Does Property Mortgage Registration Mean?

Mortgage registration records the financing interest against a specific property. The record normally identifies:

  • the property owner;
  • the financing bank or entity;
  • the mortgage amount;
  • the property covered by the mortgage;
  • the registration type.

The owner remains the registered property owner, but the mortgage appears on the property record. The mortgage must usually be released through a separate procedure after the financing obligations are settled.

What Are the Main Steps?

1. Confirm the Financing Details

The owner first completes the financing arrangements with the bank or approved financing entity. The mortgage amount, property details, parties, and contract terms should be clear before the registration file is prepared.

2. Prepare the Mortgage Documents

For an individual application handled through a Real Estate Registration Trustee, Dubai Land Department lists the following main documents:

  • a letter from the mortgagee bank;
  • three mortgage contracts certified by the bank and signed by both parties;
  • the owner’s Emirates ID for identification;
  • a valid passport copy for a non-resident foreign owner;
  • a legal power of attorney when a representative acts for the owner;
  • an electronic developer no-objection certificate for applicable provisional-sale properties.

Companies may need additional documents. These can include the trade licence, constitutional documents, shareholder or management records, authorized-signatory documents, and a notarized resolution or power of attorney. The exact requirements depend on the company’s legal form and ownership structure.

3. Check the Property Record

Before registration, the property details should match the bank letter and mortgage contracts. The title deed, usufruct title, or provisional registration certificate must refer to the correct property and owner.

Any existing mortgage, restriction, lease-to-own interest, or other registered entry should also be reviewed. An existing entry may affect whether the new mortgage can be registered and whether another transaction must be completed first.

4. Register the Mortgage

Once the file is complete, the mortgage transaction is entered and reviewed under the applicable Dubai Land Department procedure. The relevant fees are then paid, and the updated registration documents are issued electronically.

How Much Is the Mortgage Registration Fee?

Dubai Land Department currently lists a mortgage registration fee of 0.25% of the mortgage value. Other charges may apply for the title deed, property map, knowledge fee, innovation fee, and trustee service, depending on the property and transaction type.

Because fees may change and can differ between ordinary and provisional mortgage transactions, the full cost should be confirmed against the specific file before the appointment.

Does the Property Need Developer Approval?

Developer approval may be required for an eligible property recorded as a provisional sale. Dubai Land Department lists an electronic no-objection certificate from the developer among the mortgage-registration requirements for applicable provisional-sale properties.

This requirement does not apply in exactly the same way to every property. The title status and project record should be checked first.

Can a Representative Register the Mortgage?

Yes. A representative may act when the power of attorney is valid and clearly covers the mortgage transaction and the property concerned.

A general power of attorney may not always be enough. The wording should be reviewed to confirm that it grants the required authority to sign, register, finance, mortgage, and complete the related property procedure.

Is Mortgage Registration the Same as Mortgage Approval?

No. Mortgage approval is a financing decision made by the bank or financing entity. Mortgage registration is the property-registration procedure that records the approved mortgage against the property.

A bank may approve the financing before the mortgage is registered, but the registered property interest is created through the Dubai Land Department procedure.

What Happens After the Mortgage Is Registered?

The issued documents depend on the property record. They may include an updated title deed, usufruct title deed, statement certificate, or provisional sale registration certificate. The outputs are issued electronically after completion.
